2016 SHOT Show

Las VegasI had a great time this past week at the 2016 SHOT Show in Las Vegas.

Statistics:

The SHOT (Shooting, Hunting and Outdoor Trade show ) Show features more than 1,600 exhibitors filling booth space covering 630,000 square feet or about 14.5 acres.

The largest trade show of its kind in the world and the fifth largest trade show in Las Vegas. There are 12 ½ miles of aisles in the show and I have hit about a third of them today

Attendance is more than 62,000 industry professionals (not open to the general public) from all 50 states and 100 countries.

The show is divided into several different areas:

General shooting and Hunting

Firearms and Ammunition,

Law Enforcement and Tactical Gear

New Product Center

Next Generation of exhibitors

Some of the New Products I saw:

Kimber 6S Revolver small stainless hammerless 6 shot, first from the semi auto company

Kimber

Ruger American Pistol in 45 and 9mm full size double stack

Ruger

Spent time with Paul Lemke from Polycase ammunition

ARX ARX2

We talked about the new polymer technologies, the various calibers the ammo is offered in and the potential for use as reloading components for hand loaders. He indicated they are beginning to load in rifle calibers. Some people have asked about the effectiveness of the projectile design because it is not an expanding bullet, but the design creates a massive hydraulic shock. I reviewed some images from a hog hunt and it was very impressive results.

We discussed the new BATFE helpful guidelines for Closing the “Gun Show Loophole”. They listed nine, but the seem to have forgotten a few, this audio clips helps explain that.

BATFE Helpful guidelines for who needs an FFL

Here (verbatim) are the nine examples offered as specific guidance by ATF:

— Bob inherits a collection of firearms from his grandfather. He would rather have cash than the firearms, so he posts them all online for sale. He makes no purchases, but over the course of the next year he sells all of the firearms he inherited in a series of different transactions. Bob does not need a license because he is liquidating a personal collection.

— Joe recently lost his job, and to finance his living expenses he has been buying firearms from friends and reselling them though an internet site. He has successfully sold a few firearms this way, and has several more listed for sale at any one time. Joe must be licensed because he is repetitively buying and selling firearms with the primary objective of profit.

— Sharon travels to flea markets the first Saturday of every month, buying undervalued goods, including firearms. The last Saturday of every month Sharon rents a booth at the flea market and sells her items at market value for a profit. She hopes to make enough money from these sales to finance a trip to Italy next year. Sharon must get a license because she is repetitively buying and selling firearms with the primary objective of profit.

— David enjoys hunting and has a large variety of hunting rifles. He likes to have the newest models with the most current features. To pay for his new rifles, a few times a year David sells his older weapons to fellow hunters for a profit. David does not need to be licensed because he is engaging in occasional sales for enhancement of his personal collection.

— Lynn regularly travels to gun shows around her state, rents space, and sells firearms under a banner stating “liquidating personal collection.” Most of the firearms Lynn offers for sale she purchased from a licensed dealer in the prior weeks. Lynn is retired and hopes to supplement her income with the money she makes on the sales, although she has yet to turn a profit. Lynn must get a license because she is repetitively buying and selling firearms with a primary objective of profit.

— Scott has been collecting high-end firearms for years. In the six months before his son is about to enter college, Scott sells most of his collection in a series of transactions at gun shows, on the Internet, and to family and friends to provide funds to pay his son’s college expenses. Scott does not have to be licensed, because he is liquidating part of a personal collection.

— Debby has three handguns at home, and decides that she no longer wants two of them. She posts an advertisement in the local newspaper and sells the two handguns to a local collector. Debby does not need a license because she is not engaging in the repetitive purchase and resale of firearms as a regular course of trade or business.

— Jessica enjoys shooting sports and frequently goes to shooting ranges and hunting clubs. To make some extra money, she buys firearms from a dealer who is willing to give her a discount, and resells them for a profit to acquaintances from the shooting ranges and hunting clubs. She has done this a few times a month for the last several months, and has been spreading the word that she has a source for other firearms. She passes out business cards with her name, phone number and email. Jessica must get a license because she is repetitively buying and selling of firearms with the primary objective of profit.

— Doug regularly attends gun shows and rents a table to display firearms for sale. He gets firearms from a variety of sources, carefully logs each purchase into a book, and uses the purchase price to set a sales price that will realize him a net profit. Doug accepts credit card payments and typically sells multiple firearms at each of the gun shows he attends each year. He makes a substantial amount of money annually, and uses this money to live on. Doug must be licensed because he is repetitively buying and selling firearms with the primary objective of profit.

Ones the BATFE Forgot!!!

–Deshaun lives in Chicago where they make it almost impossible for a gun store to operate legally, because he only deals in stolen guns he cannot obtain a license, and besides the local Politicians need a high body count so they can continue to push for more gun control.

–Manuel is supplying guns to the local MS-13 gang, he trades only for drugs and cash and does not accept credit cards. Manuel does not need a license because he is an illegal alien (previously deported 3 times) and now lives in a Sanctuary city run by Democrats.

— Mohamed Abdullah and Aknod Faisal obtained their guns through an ISIS contact for the purpose of Jihad. ISIS does not need a license because everybody knows Islam is the religion of peace and not associated with terrorism in any way.

What You Need to Know About Obama’s Plan to Bypass Congress on Guns

With Congress unlikely to oblige on his calls for gun control after the San Bernardino terrorist attack, President Barack Obama is expected to act alone on the issue soon. (Photo: Saul Loeb/UPI/Newscom)

Stymied by Republicans in Congress, President Barack Obama is expected to act alone to take executive action to tighten restrictions on gun sales.

White House adviser Valerie Jarrett, speaking at a vigil last week for victims of the 2012 Newtown, Conn., shooting, confirmed that the president has asked his staff to complete a proposal that would expand background checks on gun sales without congressional approval.

Before Jarrett’s public pronouncement, The New York Times and other mediahave reported the Obama administration’s action would broaden the definition of who is considered a high-volume gun dealer, a move that could force background checks for certain sales at gun shows, online, and in other areas that fall outside the law.

The Gun Control Act of 1968 already requires professional gun dealers to be licensed by the Bureau of Alcohol, Tobacco, Firearms, and Explosives. Buyers of guns from federally licensed dealers are subject to background checks.

But the existing law doesn’t clearly define what it means to be in the business of selling guns.

Obama’s executive action would intend to clarify that distinction in a way that broadens who is in the gun-selling business, so that more sales are “on the books” and thus require a background check.

According to legal experts who spoke to The Daily Signal, Obama would be within his rights to pursue such an action because he would be simply reinterpreting how to apply already existing law, rather than creating new legislation.

But these experts also said Obama’s action would have limited impact on the availability of guns.

“When Congress passes an ambiguous statute, the president absolutely has it within his authority to interpret federal statutes for purposes of how he chooses to implement them,” said Adam Winkler, a UCLA professor focused on constitutional law and the Second Amendment.

“In this case, the law requires someone to obtain a license if it’s in the business of selling firearms. But there is no clear definition of what that means. Is it just someone who sells guns, or do they need to sell a certain number of guns, a specific type of gun, or sell it in a specific place? We don’t know the parameters. So it’s up to administrative agencies to define what that means.”

Nicholas Johnson, a Fordham University law professor focused on firearms law and the Second Amendment, agreed that there is “no doubt” Obama could use existing law to expand the definition of a gun dealer, though he expects the effort to be challenged in court.

“They are not changing the statute,” Johnson said of Obama’s proposed action on guns. “They are looking at the 1968 Act and saying, ‘How can we administratively change the definition of what it means to be a dealer and to capture it in away to cover more people in gun shows?’ There is no doubt the president and ATF have the authority to change the definition of what it means to be dealing in firearms.”

Winkler and Johnson say the key question that Obama is probably weighing is how broadly or narrowly to define what would qualify as a high-volume gun dealer.

If they reach too far, Winkler says, the NRA and other opponents of gun control will argue that the stricter rules would unfairly burden individuals who aren’t professional sellers.

“There may be arguments that however Obama interprets it is so divorced from what Congress intended that it goes too far and it’s illegal in that way,” Winkler said. “I don’t think people would think that someone who inherits a gun from their father and sells it at a gun show is engaged in the business of selling guns.”

Hans von Spakovksy, a senior legal fellow at The Heritage Foundation, agrees that Obama should be careful in how he applies the definition of a gun-selling business.

As von Spakovsky notes, Section 21 of the 1968 Gun Control Act defines a person “engaged in the business” of selling guns as “a person who devotes time, attention, and labor to dealing in firearms as a regular course of trade or business with the principal objective of livelihood and profit through the repetitive purchase and resale of firearms.”

“So it depends on what the president tries to do,” von Spakovsky said. “Notice that this definition only applies to people who sell firearms as ‘a regular course of trade or business’ to make a living; thus, people who engage in occasional sales or for whom it is not their principal livelihood are not firearms dealers. The president has no authority to expand this statute beyond these terms. If he does so, he will be acting outside of the law.”

Obama has acted alone on gun control before.

After the murder of 26 children and staff members at Sandy Hook Elementary in Newtown, Obama imposed 23 executive actions that are considered modest and to have had little impact.

At that time, Obama had pushed Congress to pass a law requiring universal background checks for all gun purchases, but the measure failed.

More recently, after the San Bernardino terrorist attacks, Obama is calling for Congress to ban people on the government’s no-fly zone from buying guns, and to order restrictions on assault weapons.

The Republican-controlled Congress has shown little interest in obliging. If that continues, Obama is limited in what he can do without them, the law experts say.

“The truth is, the president’s hands are pretty tied,” Winkler said. “There is not a lot he can do on guns. Anything significant really requires going through Congress.”

Added Johnson:

I am cynical. I call this security theater. Do I expect this action to have any sort of impact? No, other than leading to another run on people buying guns, which will bring more inventory on the market that could be stolen and end up on the black market. Most crime guns are illegal or stolen. This is a vicious cycle. The president is going after low-hanging fruit.

December TriggerTalk Article “The Gun is NOT the Problem”

On November 13th 2015 I was with my buddy Don as we were preparing for “Opening Day” of Firearms season. Rifles were sighted in and cleaned, Blinds prepared, clothing set out, binoculars and range finder cleaned, food and beverage purchased. We were all set for a few days in the woods centered on our enjoyment of guns, the outdoors and friendship.

Like many of you though, we were glued to the television set in the evening and into the night as the information played out from the terrorist attacks in Paris, France.

So many thoughts: the determination of assailants to spread fear amongst the population was evident in the coordination and savagery at multiple locations. The senseless killing, the inability of the people to defend themselves and the thankfulness that we in America have the means to defend ourselves and our loved ones.

It did not take long for the anti-gunners to crawl out from under their rocks. First a relatively unknown actor felt the need to compare the numbers of slaughtered (18 at the time of his tweet) versus some of the shootings we have had in this country.

Mother’s Demanding Action quickly issued a letter expressing sympathy for the people of Paris for their losses due to “Gun Violence” please note they did not use the term terrorism.

The Washington D.C. based Violence Policy Center  issued the following statements

“In light of new concerns over terrorism, we should rethink our policies that allow military-style assault weapons to be purchased by virtually anyone — including potential criminals and terrorists,”

“There is no reason for assault rifles, assault pistols, and assault shotguns to be sold on the civilian market. These weapons are designed with only one purpose: to kill as many people as possible in the shortest possible amount of time,” says the VPC.

Even the Mayor of our own violence prone city of Philadelphia felt the need to comment.

“There is really no level of distinction between the violence that goes on, on the streets of America on a daily basis and the episodic acts of international terrorism that also take place – primarily in cities,” Nutter said.

This is not a new phenomenon from the Anti-Gunners, they are often seen and heard making statements  about the need for gun control even before the victims have been moved and the blood washed away.  Their message is always the same “We need more Gun Control.

The weapons used in the most recent terrorist attacks are not being purchased from the local gun stores by law abiding people.  The people committing these heinous acts are procuring their guns on the black market or importing them from friendly countries. The grenades and explosives are often from military caches and stores they have taken over or stolen  And no amount of gun control will prevent them from trying to strike terror into the unarmed populous.

If only them made Murder and Terrorism illegal and made Paris a gun free zone! “Oh Wait”

THE GUN IS NOT THE PROBLEM!
